对符合行政复议、行政诉讼受理条件的行政争议，行政执法监督机构应当引导当事人依法申请行政复议、提起行政诉讼；对已经进入行政复议、行政诉讼程序的行政争议，行政执法监督机构不重复监督。
第七十八条 卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款；情节较轻的，处五日以下拘留或者一千元以下罚款。
